MINUTES OF FEBRUARY 25, 2002 REGULAR MEETING    


A.      Call to Order

         Metzler called the meeting to order at 7:36 p.m.

B.      Roll Call

D.      New Business

         1.  File #W2002-14 – Application for an activity within the Regulated Area for
         a single family home including grading located off Liska Road (Map 32, Lot 7-
         7, 2.37 acres).  Estate of Joseph Mihaliak owner/applicant.  (Received on
         02/25/02, No Decision before 03/11/02, Hearing or Decision by 05/13/02.)

         Mark Peterson of Gardner & Peterson Associates spoke.  He said that this is part of
         a 10-lot subdivision approved back in 1988.  The Wetlands permit has expired, he
         said.  He said there is very little buildable area, the leach field is outside the
          setback and the only disturbance will be grading and a foundation drain.  Approval
          has been received from the Health Department, he said.

         Alternatives were discussed, but Mr. Peterson still thought this was the best spot.  
         He said that soil types will be added to the plan and he will propose some kind of
         drainage near the bottom of the driveway and pipe it into the town drainage system.
        He said he was left with piece of land without a lot of area to place a house and
         that regulated areas are being avoided as much as possible.

         Blessing asked if the infiltrator systems were of standard size, and Mr. Peterson
        replied yes.  Blessing informed Mr. Peterson he should show on submitted plan a
          stone leaching system, not infiltrator.  Blessing asked if the drainage off the
          driveway could get to the inverts, and Mr. Peterson replied yes, he can run a pipe
          and tie into existing drainage. There will be minimal flow, he said.  Blessing asked
         if the applicant had checked the capacity of the existing system, the applicant
          answered no, and Blessing stated he wanted this to be verified.  Blessing said
          that hopefully everything was properly designed originally.  He said that we’re six
         inches into grade.

         Metzler asked if the applicant could come back with additional information, and
         Mr. Peterson replied yes.

         Blessing asked about the eastern side slope.  He said the slope rights are reserved.
         He asked if the driveway will be paved, and the applicant replied that due to the
         steep slope, the driveway will have to be paved.

2.      File #W2002-11 – Application for an activity within the Regulated Area for a
        28’ x 38’ garage located at 43 Mason Road.  David Wilson owner/applicant.

        04/08/02.)

        Mr. Wilson presented a revised plan.  Gary Jones said he is familiar with this site.
         The applicant discussed three alternatives with Mr. Jones before the meeting.  Mr.
        Jones said the lay of the land goes uphill before the wetlands.

         Blessing asked the applicant several questions:  Does the garage have regular cross-
        sole footing?  Is the finished grade 2 ft. above the area around it?  The applicant
         answered yes to both questions.  In answer to Blessing’s question about what the
        applicant would do with the fill material, the applicant replied that he may use it on-
        site; it would be shipped out if necessary.  

         Mr. Wilson said there is very little wood.  He said he was very limited as to any
         future expansion  to the home.  He stated there would be no heat, just
        electricity in the garage.  He said the seasonal brook is dry in July and August.

        Mr. Jones said he has seen the site in the past but not recently.

       MOTION:    To approve application with proposed Alternative “A,” 15 ft.
                              away from the original proposal.

3.     File #2002-5 – Application for a Wetlands permit for a logging operation
       located at 375 Tolland Turnpike (Map 22, Lot 20).  Jonathan Covault owner,
       Dan Donahue applicant.  (Received on 01/28/02, No Decision before 02/11/02,
       Hearing or Decision by 03/25/02.)

       Wetland Commission members with the exception of Blessing did a site walk
       last Saturday.

        Mr. Donahue said he would be using the existing logging road to gain
       access to a small part of the property.   He said there are a couple of wetland
        crossings—one has a bit of stream flow, the other doesn’t.  He said this is a
        fairly small harvest with a 7-10 day time frame and will be done with the same
       logging crew that did the first project.  Mr. Donahue said there is ample (100 ft.)
      distance between the existing trail and the river.  He said it would be very unlikely to
       have sediment from the trail reach the river.  The harvest will be done in the dry
       season, he said.

        Metzler commented that the proposed way is the only way to go in and out without
       making a mess.  There is one little trench swell that could be corduroyed.

       MOTION:    To approve with condition that prior to any activity staff will
                              go out with Mr. Donahue and determine the limits of the
                              location of S&E controls (haybales).

4.      File #2002-13 – Application for a Wetlands Permit for activity within the
        Regulated Area for a Single Family Home at 61 Turnpike Road (Map 45, Lot
        6).  Richard Dezso applicant, Mary R. Drew owner.  (Received on 02/11/02, No
        Decision before 02/25/02, Hearing or Decision by 04/08/02).

         Mr. Pelletier, Engineer, representing applicant, passed out maps with some
         additions.  He said the parcel was originally Designed Industrial; the buildable area
         is actually quite small since much of the property is wetlands.  He said the owner
 wants to build a single-family house as far as possible from the highway due to
 noise.

         
          Mr. Pelletier said he had a letter from the Health District saying the lot was suitable
         for building.  He said the proposed activity consists of grading and a footing drain,
         very little excavation will be done, and silt fencing will be used.  

          Mr. Pelletier said no alternatives are shown because they are not needed.  He said
         we will be working only within the non-regulated area with no activity within
         the wetlands area.  He said a field survey was done, limits of disturbance were
         added.  Mr. Pelletier reported that the soil scientist said there would be no drainage
          on the wetlands area, soil types were added to the plan that utilities will be above-
         ground, and that the existing dug well has to be filled in by a licensed well driller.

          Blessing asked if the proposed activity includes a slight bit of grading for the leach
          field and an outlet for a footing drain, and the applicant replied yes.

          The members will look at the site on their own, and the applicant will come back
          at the next meeting.

5.      File #W2002-12 – Application for an activity within the Regulated Area for a
        driveway for a single family home located off Latham Road (Map 9, Lot 32,
        7.93 acres).  Michael Nogas owner/applicant.  (Received on 02/11/02, No
         Decision before 02/25/02, Hearing or Decision by 04/08/02.)

        Michael Nogas said that very little fill is needed and the house will be on-grade in
        the back, further away from the wetlands and power lines.  He said the plans have
        not been submitted to the Health Department yet.  He said that no alternatives are
        shown because nothing is being done in the wetland areas.  He said that the
        plans show all activity within the buffer zone.  He said that no underground utilities
        are proposed in this application and that they propose to do a little grading around
         the house.

        Mr. Jones stated that ownership of this property needs to be proved.  An attorney
        needs to complete an affidavit and a B100 needs to be filled out.

         The applicant agreed to get paperwork in order within the next two weeks.  Metzler
        said this is a unique parcel with additional land to be subdivided.  Mr. Nogas said
        he is trying to use all the land on one side of the power lines.  Metzler said
         Mr. Nogas needs to get the needed information in order.
